Align Technology has filed a complaint with the U.S. International Trade Commission seeking to block Angelalign clear aligner imports, while Angelalign denies the claims and says it will defend itself.
Align Technology has filed a complaint with the U.S. International Trade Commission (ITC) under Section 337 of the Tariff Act, alleging that Angelalign Technology is unlawfully importing and selling clear aligners that infringe on Align’s patents.
Allegations of Patent Infringement
According to Align, Angelalign’s clear aligner products incorporate technologies developed and patented by Align without authorization. The company is seeking an exclusion order to block the import of the alleged infringing products into the U.S. and a cease-and-desist order to prevent further sales of those products already in the domestic market.
Part of Broader Legal Strategy
This ITC action is the latest in a series of legal proceedings Align has initiated against Angelalign. In August, the company filed lawsuits in the U.S. District Court, the China Intermediate People’s Court, and the European Unified Patent Court. Align stated that these actions are aimed at protecting its investments in innovation, aligner fabrication, and treatment planning.

Angelalign Response
When reached for comment, Rich Hirschland, chief commercial officer and senior vice president of Angelalign Technology, told Orthodontic Products, “The Align complaint to the ITC is meritless. The company will vigorously defend itself and is confident it will prevail in this complaint along with the other litigation that Align has initiated.
