A shareholder lawsuit against Align Technology Inc, San Jose, Calif, and its president was dropped last month. The lawsuit, brought by lead plaintiff Plumbers and Pipefitters National Pension Fundin August 2009 in the US District Court for the Northern District of California, was dismissed with prejudice and a stipulation between the parties that prevents them from seeking or asserting any claims against one another for fees, expenses, costs, or sanctions.
The stipulated dismissal with prejudice terminates the matter and follows the Court’s previous dismissal of the plaintiff’s second amended complaint for failure to state a claim on February 3, 2012.
