A shareholder lawsuit against Align Technology Inc,San Jose, Calif, and its president was dropped last month. The lawsuit,brought by lead plaintiff Plumbers and Pipefitters National PensionFundin August 2009 in the US District Court for the Northern Districtof California, was dismissed with prejudice and a stipulation betweenthe parties that prevents them from seeking or asserting any claimsagainst one another for fees, expenses, costs, or sanctions.
The stipulated dismissal with prejudice terminates the matter andfollows the Court’s previous dismissal of the plaintiff’s second amendedcomplaint for failure to state a claim on February 3, 2012.
