ClearCorrect LLC, Houston, has filed a countersuit against Align Technology’s patent infringement suit. Align filed the original suit on March 2, 2011.
ClearCorrect’s countersuit asks the Court to declare 408 of Align’spatent claims and 10 of its patents invalid. The countersuit reportedlycites much of the evidence raised in Align’s previous patent caseagainst Ormco Corp, Orange, Calif. In the Ormco case, the federal court ruled that 11 of Align’s patent claims were invalid.
