Discus Dental LLC, Culver City, Calif, and Zap Lasers LLC, Pleasant Hill, Calif, have jointly filed a lawsuit against Biolase Technology Inc, Irvine, Calif, in federal court in Los Angeles, The lawsuit asserts against Biolase claims for patent and trademark infringement and unfair competition, and seeks monetary damages and an injunction.

The lawsuit has been filed as a result of Biolase’s offering for sale in the US its iLase™ cordless soft-tissue laser. According to their announcement, Discus Dental and Zap intend to vigorously enforce their intellectual property and related commercial rights against Biolase and any iLase distributors. Discus Dental and Zap Lasers are represented by legal counsel from the New York office of Chadbourne & Parke LLP.

According to announcement on the Biolase Web site, "The allegations are merely based on the shape of the iLase, and are not based at all on the groundbreaking functions of the laser unit itself."

David M. Mulder, CEO of Biolase, said, "We are very confident in the breadth of our intellectual property portfolio, and in the strength of our laser technology, and we intend to vigorously defend the company against these allegations levied by Discus and Zap."
